About the Autoconsultant website

Our website contains information about the history and statistics of the vehicle sales on the leading auction portals. User-friendly structure of the Website allows to quickly and effectively search data about the given lot or VIN number, filter data by technical parameters of the vehicle or auction parameters. Users can also view a report about the selected lot \ VIN number. To use all features of the website, user needs to be registered and have a proper billing profile. When using any of the functions or services of the Site, any capable individual (hereinafter referred to as the User) is subject to the conditions and restrictions set forth in these Terms of Use of the Site (hereinafter the Terms).

  1. GLOSSARY
    1. This Terms and conditions use the following glossary terms:
      1. Site is a set of data, electronic (digital) information, other objects which are copyright protectd, which are connected with each other and are structured in the scope of the URL address https://autoconsultant.com.ua
      2. User is a person or legal entity who uses the Site with the informational purpose on the free or paid basis.
      3. Site Administration (We) is a person or group of people which have a set of rights to manage the Site, moderate its data, place Site content and interact with Consumers, as well as perform other actions, connected to the use of the Website.       4. Service is provision of the informational services, namely provision of the access to the Site and use of its functions for personal non-commercial purposes, which can not be treated as provision of the consulting and as the only source of information when purchasing the used vehicle.
      5. Personal backoffice is the gated part of the Site which is available to the User after undergoing the registration and is used for the configuring and using the Autoconsultant service, saving and editing personal data of the User. Personal backoffice includes data which the User has provided during registration on the Site and allows autoconsultant.com.ua to identify the User with the individual login and password.
      6. Registration in the personal backoffice is the voluntarily carried out by the User, which consists in performing a set of actions by the User (according to a special form), including the provision of personal data, in order to create a Personal Account and access to Autoconsultant services.
      7. Login is a unique name (identifier) of the User on the Site which is used by the User to authorize and login into the personal backoffice in order to perform all functions which are available in the Site functionality in accordance with this Terms and Conditions (including but not limited).
      8. Password is a secret set of symbols which is required for the entry to the personal Backoffice on the Site. Password is known only to the user .
      9. Report is a detailed information about the vehicles which are available to the users on the auction portals in case if the vehicle was a subject for the auction.
      10. Lot is a vehicle which was a subject to the auction (name, technical and quality characteristics, costs etc..).
      11. All other terms and definitions which are mentioned in the texts of these Terms and conditions should be treated by the parties in accordance with the Terms and Conditions, and if not defined here, then in accordance with the norms of the Ukrainian and international law.
    2. If you proceed using the Site with the personal backoffice or with no registration, you agree to the specified in this document Terms and Conditions.
  2. GENERAL TERMS
    1. This page defines terms which regulate the access and use of the site autoconsultant.com.ua (hereafter Site).
    2. This site includes both paid content (hereafter Paid Content), access to which is provided in accordance with the article 4 of the Terms and Conditions, as well as with the Public offer, and the content which does not require payment.
    3. Use of the Site, including information, materials, other parts, is regulated by the Terms provided below, as well as by current Ukrainian and international law.
    4. If you do not agree with these terms and do not accept the Terms, please leave the Site.
    5. We have right to change, add and remove the parts of these Terms at any time and those changes become valid immediately after the publication. It is your responsibility to read these Terms before each use of the Site and if you proceed using the Site, you agree to all those changes.
  3. LICENSING TERMS
    1. In accordance with the Terms and our Policy we provide our users a limited, personal, non-exclusive, revocable and non-transferrable license for the site use. Site content can be used only for personal non-commercial use, excluding the cases when you have received a written permission from the Site administration to use with some other purposes.
  4. SITE USE
    1. You can use the Site only in accordance with these Terms, regulations of the Public offer which is published on the page www.autoconsultant.com.ua/terms, as well as in accordance with applicable legal terms.
    2. When you fill in any form, including registration form, you are obliged to put required, full and correct Site data.
    3. Any legally capable individual over the age of 18 can use the Site.
    4. If you saw information on the Site that in your opinion is inaccurate, incomplete or such that should not be posted on our Site for certain reasons and must be deleted or edited, we ask you to contact us with a reasonable, official letter to the address [email protected], which we can review and give an answer.
    5. In case of absence of a specific Lot on the Site, the Site Administration has the right, at the request of the User, to post it on the Site after the User confirms the authenticity of the lot and the data confirming its purchase, provided to the address [email protected]
    6. User takes on the responsibility not to reproduce, not to copy, not to sell and not to use the information and materials which became available to him via the use of the Site except the personal use.
    7. User agrees not to post or upload content or elements to inappropriate categories and services on the Site.
    8. The user is prohibited from distributing or posting spam, unwanted or massive electronic messages, spread viruses, or perform any other actions that could harm the Site.
    9. The User takes on the responsibility and confirms that when using the services of the Site which will not in any way contribute to the fraud, deception or abuse of trust; will not carry out transactions with stolen or counterfeit items and / or items the use of which is prohibited with the active Ukrainian and international law; will not affect the copyrighted (including intellectual properly) rights of the Site administration or third parties; will not publish data which offend someone’s dignity.
    10. The User undertakes and confirms that using the Services, in any case, he does not contribute to fraud, deception or abuse of trust; does not carry out transactions with stolen or counterfeit items and / or items whose free circulation is limited and / or prohibited in accordance with applicable law; does not affect the ownership of the Contractor or third parties, including intellectual property; will not publish information that offends someone's honor, dignity or business reputation; does not carry out slander, does not threaten; will not call for the commission of crimes, and also does not incite ethnic and ethnic hatred; will not support terrorist and extremist activities.
  5. FREE CONTENT
    1. If the user has not paid proper fees which are defined by the Site pricing, he gets limited access to the information published on the Site, including photos of the vehicle, limited information about the parameters of the vehicle and auction where the vehicle was traded.
  6. PAID CONTENT
    1. A part of the content which is published on the Site is considered paid and is available only to the users who has paid proper fees. User is required to do timely payments in accordance with the selected billing profile in order to get access to the paid content.
    2. Besides Site administration has the right to unilaterally change the cost of providing access to paid content, before the payment date via the publication of new price on the Site.
  7. ACCESS TO THE BACKOFFICE
    1. In order to receive access to the full functionality of the Site user needs to register, fill in all fields of the registration form, including name, last name, email and phone of the User.
    2. User agrees to create and use only one account to the Backoffice and not to pass the access or account details to other parties.
    3. During the registration User is required to provide accurate and up-to-date information including User-specific login, email, password for Site access. Site administration has the right to change the data in the registration fields of the user and require User to provide extra information.
    4. After registration Use gets access to the personal Backoffice, using the given login and password, which allows to structure the search results and get access to the selected lots (bookmarks, search history, selected lots).
    5. After registration login and password created by the User are the sufficient data for the access to the Service. User doesn’t have the right to transfer the login name and password to third parties, is responsible for storing the data, personally using the way to store the data. Any action, which are performed with the user account identified by login name and password, are considered to be performed by the User.
    6. Access to the Site does not provide you with material or intellectual property rights to the content posted on the Site.
    7. We can cancel or suspend your access to the Site, My Account, if you share your credentials to enter the account.
    8. You are responsible for maintaining the confidentiality of credentials that you will not transfer to third parties.You are not allowed to:
      • choose or use another person’s credentials to impersonate that person,
      • use account information without permission of the copyright holder,
      • use credentials at their discretion if they are or are considered offensive.
      Failure to comply with the above provisions is considered a violation of the Terms, which may lead to the immediate termination of your account and restrict access to the Site.
    9. Any improper use of the Site is prohibited by law and may result in civil and criminal liability.
  8. SECURITY OF THE PERSONAL BACKOFFICE
    1. You must inform us at [email protected] about any known or suspected cases of unauthorized use of your Personal Account, or any known or suspected breach of security, including the loss, theft or unauthorized disclosure of your credentials to access the Backoffice.
  9. REVIEWS
    1. We welcome your suggestions, ideas, comments and other feedback (hereinafter referred to as the “Feedback”). By submitting a review, you grant us the right to use it without any restrictions or compensation for you.
    2. You are solely responsible for the content of the Reviews you have created. The administration cannot control every material and is not responsible for the content of these messages, we reserve the right to delete, move or edit materials that at our discretion are offensive, indecent, inappropriate or libelous.
  10. POLLS AND ONLINE QUESTIONNAIRES
    1. The site administration can contact you by e-mail or phone regarding your participation in the User survey, and ask questions in order to improve the operation of the Site and for a better understanding of our Users. This information will be used in compliance with the requirements of the legislation of Ukraine on the protection of personal data. Any information that we receive in such surveys will not be passed on to third parties, with the exception of generalized depersonalized data.
  11. DISCLAIMER OF WARRANTIES
    1. The user assumes all risk of using the Site. The owner of the site or the Administration does not guarantee the absence of errors or the continuous operation of the Site.
    2. The materials of the Site are provided on an “as is” basis, without providing any warranties, direct or indirect, including the warranties of fitness for any particular purpose. At the same time, guarantees arising from the law are not excluded or cannot be excluded, limited or changed by virtue of the legislation applicable to these Terms.
  12. LIMITATION OF LIABILITY
    1. The User acknowledges that the provisions of this section apply to the entire content of the Site, as well as that the use of the Site or materials available on the Site is at your own risk.
    2. The owner of the site and the Administration are not liable for any losses, including direct and indirect losses or damage caused by the consequences of using the Site, as well as losses from the payment of fines arising from the use or inability to use the Site.
    3. The User acknowledges that the Site Owner and the Administration is not responsible for the offensive, indecent or illegal behavior of other Users or third parties, and assumes all risks that may arise from the above.
    4. Site administration is not responsible for the discrepancy of the Lot with the expectations of the User and / or his subjective assessment. Such a mismatch with expectations and / or a negative subjective assessment is not a reason to consider the Services provided to be of poor quality, or not to an agreed extent.
    5. In addition to the above conditions, the Site Owner and the Administration are not liable, regardless of the reasons or duration, for any errors, inaccuracies or other shortcomings of the information published on the Site, for the untimely and interrupted transmission of such information to the User or any claims arising in connection with this or losses, except as expressly provided by law. The owner of the site and the Administration are not responsible for claims made by third parties, claims, as well as for any losses caused to third parties, including, but not limited to, lost profits, penalties or damage caused by the consequences of using the Site. The site owner does not guarantee the timeliness, consistency, accuracy and completeness of the information provided, except as expressly provided by law. At the same time, the Site Owner and the Administration do not provide any guarantees regarding the possible results of using such information. The owner of the site and the Administration do not bear any responsibility for the accuracy, reliability of the judgments, recommendations or statements of third parties posted on the Site. The owner of the site and the Administration under no circumstances shall be liable for losses and losses caused by the fact that the User used the information of third parties received on the Site.
  13. TERMINATION OF THE USE OF THE SITE
    1. You agree that the Administration may terminate your access to the Site at any time and for any reason, including, but not limited to, if the Administration considers that you have violated or acted contrary to the provisions of these Terms. After such termination, you will be deprived of the right to use the Site. You agree that any such termination of your access to the Site may be carried out without prior notice, the Administration may immediately disable or delete your account and password to enter your Personal Account, as well as all related information and files.
    2. The user has the right to stop using the Site at any time.
